These Terms & Conditions ("Terms") govern the access to and use of the The New Own website, digital platform and related services (collectively, the "Platform"), as well as the rental and purchase of products made available through the Platform.
By creating an account, accessing the Platform, placing an Order or using any service offered through the Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them.
Please read these Terms carefully before using the Platform.
1. WHO WE ARE
1.1 The New Own

The New Own S.r.l.s. is referred to in these Terms as "The New Own", "TNO", "we", "us or "our".
1.2 Your contractual counterparty
When you rent or purchase a Product through the Platform, your contractual relationship is with The New Own.
The New Own is therefore your contractual counterparty for:
- the rental of Products through the Platform;
- the purchase of Products through the Platform;
- the payment process associated with such transactions;
- the collection and return process;
- the logistics services forming part of the Order;
- the management of cancellations and refunds;
- the management of any applicable security Deposit;
- any optional service expressly included in your Order.
The Brand whose Product is displayed on the Platform is a commercial supplier and partner of The New Own. The Brand is not your contractual counterparty for the rental or purchase transaction concluded through the Platform.
The contractual relationship between The New Own and the relevant Brand is governed separately and does not affect your rights against The New Own.
2. DEFINITIONS
For the purposes of these Terms:
"Account" means the personal account created by a User on the Platform.
"Brand" means a fashion brand or other professional supplier whose Products are made available to The New Own for rental and/or sale through the Platform.
"Care Service" means an optional garment-care, washing or cleaning service offered through the Platform.
"Collection Point" means a location designated by The New Own for the collection and/or return of Products.
"Customer", "User", "you" or "your" means any individual using the Platform for purposes outside their business, trade, craft or profession.
"Deposit" means any security amount required in connection with a Rental and displayed before completion of an Order.
"Order" means a request submitted by a Customer through the Platform to rent or purchase a Product or to receive another service.
"Order Placed" means an Order successfully submitted and for which payment has been successfully authorised or completed.
"Order Confirmed" means an Order that has passed the applicable cancellation stage and for which the Product has been requested from the relevant Brand.
"Platform" means the digital services operated by The New Own, including its website, applications, digital interfaces and related systems.
"Product" means a garment, accessory or other fashion item made available through the Platform.
"Purchase" means the purchase of a Product through the Platform.
"Rental" means the temporary use of a Product by a Customer for the Rental Period specified in the Order.
"Rental Period" means the period selected by the Customer for the use of a Product.
"Coupon" means a credit issued by The New Own for use on the Platform in accordance with these Terms.
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Eligibility
The Platform is intended primarily for consumers.
Unless otherwise expressly stated by The New Own, you must be at least 18 years old and legally capable of entering into binding contracts.
By using the Platform, you confirm that the information you provide is accurate, complete and up to date.
3.2 Account creation
Certain services require an Account.
When creating an Account, you may be required to provide information such as your name, email address, telephone number, delivery or Collection Point information and other information necessary to provide the requested services.
3.3 Account security
You are responsible for keeping your Account credentials confidential and for all activity performed through your Account.
You must notify The New Own promptly if you believe your Account has been accessed without authorisation.
3.4 Suspension or termination
The New Own may suspend or terminate an Account where reasonably necessary, including where:
- false or misleading information has been provided;
- the Platform is used fraudulently or unlawfully;
- Products are deliberately damaged, lost or not returned;
- payments due to The New Own are not made;
- the User attempts to circumvent the Platform;
- the User interferes with the security or proper operation of the Platform;
- the User materially or repeatedly breaches these Terms.
Such measures do not affect rights already accrued by the Customer under applicable law.
4. THE PLATFORM AND THE PRODUCTS
4.1 Circular fashion service
The New Own operates a phygital platform designed to make access to fashion more circular, accessible and responsible.
Depending on availability, the Platform allows Customers to:
- discover Products supplied by participating Brands;
- rent Products for defined periods;
- purchase rented Products;
- collect and return Products through designated Collection Points;
- access optional garment-care services;
- participate in community, promotional and other initiatives offered through the Platform.
4.2 Product information
Each Product may be presented with photographs, descriptions, materials, colours, sizes, fit information, care instructions, condition information and other relevant details.
The New Own uses reasonable efforts to ensure that Product information displayed on the Platform is accurate and current.
The appearance of colours may vary depending on the Customer's device or display settings.
4.3 Product condition
Products may be new or may have previously been rented.
Where appropriate, information concerning the condition of a Product will be displayed on the Platform.
Because Products may circulate through multiple Rentals, minor signs of previous use may exist and do not necessarily constitute a defect.
Products must nevertheless be supplied in a condition suitable for the relevant Rental and consistent with the information provided to the Customer.
4.4 Product availability
Product availability is subject to stock and operational availability.
The appearance of a Product on the Platform does not guarantee that it will remain available until an Order is completed.
If, after an Order has been placed, the Product becomes unavailable for reasons outside the Customer's control, The New Own will contact the Customer and provide an appropriate remedy, which may include a refund or Coupon.
5. RENTAL SERVICE
5.1 Rental periods
Depending on the Product and availability, the Customer may select one of the following Rental Periods:
- 2 weeks
- 1 month
- 3 months
The available Rental Periods and corresponding prices will be displayed before payment.
5.2 Beginning of the Rental
Unless otherwise expressly stated in the Order, the Rental begins when the Customer collects the Product at the selected Collection Point.
5.3 Use of the Product
During the Rental Period, the Customer must use the Product responsibly and in accordance with its intended purpose and any care instructions supplied with the Product.
The Customer must not:
- intentionally damage the Product;
- materially modify or alter the Product;
- remove labels or identifying elements where removal is not necessary for normal use;
- transfer, sub-rent or commercially exploit the Product;
- use the Product for unlawful purposes;
- expose the Product to avoidable damage or misuse.
The Customer is not responsible for ordinary wear and tear resulting from normal and appropriate use.
5.4 Expiry of the Rental
At the end of the Rental Period, the Customer must return the Product using the return procedure specified by The New Own.
The Product may then be inspected, cleaned, maintained and prepared for a subsequent Rental.
5.5 Failure to return
Failure to return a Product within the applicable timeframe may result in additional charges, subject to applicable law and the specific conditions communicated to the Customer.
Such charges may include additional Rental charges, recovery costs or compensation for loss of the Product where legally permissible.
The New Own may restrict future use of the Platform until the matter has been resolved.
6. ORDER PROCESS AND DELIVERY
6.1 Order information
Before submitting an Order, the Customer will be shown the relevant information, including, as applicable:
- Product;
- Brand;
- Rental Period or Purchase option;
- price;
- applicable taxes;
- Deposit;
- Care Service;
- Collection Point;
- applicable delivery or collection information;
- applicable cancellation or withdrawal information.
6.2 Order submission
The Customer is responsible for reviewing the information before completing the Order.
By clicking the final order button, the Customer confirms the Order and agrees to pay the amount displayed at checkout.
6.3 Order confirmation
Following successful payment, The New Own will provide an Order confirmation through the Platform and/or by email.
An Order may remain subject to Product availability and fulfilment.
6.4 Product preparation
Following an Order, The New Own will request the Product from the relevant Brand.
The Brand is expected to make the Product available to The New Own within 48 hours of the Order, according to the operating arrangements between The New Own and the Brand.
6.5 Transfer to the Collection Point
Where the Product is held at a location different from the Customer's selected Collection Point, The New Own may collect the Product from the Brand and transfer it to the Customer's Collection Point.
The operational target is to perform this transfer within 24 hours after the Order has been confirmed.
6.6 Collection availability
The Product should normally be available for collection within 72 hours from the Order being placed, subject to Product availability, transport conditions and circumstances outside The New Own's reasonable control.
6.7 Delays
If a material delay occurs, The New Own will inform the Customer as soon as reasonably possible.
Where applicable law or these Terms provide a right to cancel due to the delay, the Customer may exercise that right.
7. CANCELLATION BY THE CUSTOMER
7.1 Commercial cancellation within 48 hours
Without prejudice to any mandatory statutory right of withdrawal or other consumer protection right, the Customer may cancel an Order within 48 hours of payment.
Where the Order is validly cancelled within this period, the amount paid for the cancelled Order will be refunded.
7.2 Cancellation after the 48-hour period
Once the Order has been confirmed and the Product preparation process has begun, the ordinary 48-hour cancellation period expires.
Subject to mandatory consumer rights, the Customer may request a Coupon of equivalent value within 72 hours from the original Order, as provided by the Platform.
The Coupon may be used for an eligible future Rental on the Platform.
7.3 Delayed or unavailable Orders
Where an Order cannot be fulfilled or is materially delayed for reasons attributable to The New Own or its operational network, the Customer will receive the remedies required by applicable law and/or expressly communicated by The New Own.
8. STATUTORY RIGHT OF WITHDRAWAL
8.1 General right
Where applicable under Italian and European consumer law, the Customer has the right to withdraw from a distance contract without giving a reason within the statutory period.
For distance contracts to which the ordinary statutory withdrawal period applies, that period is 14 days, subject to the exceptions provided by law.
Nothing in these Terms limits or excludes any mandatory right of withdrawal.
8.2 Exercise of withdrawal
Where a statutory withdrawal right applies, the Customer may exercise it by:
- using the withdrawal function made available through the Platform, where applicable;
- sending an unequivocal statement to The New Own at e-commerce@thenewown.com; or
- using the model withdrawal form set out in Annex I.
The online withdrawal function, where required by applicable law, will remain accessible during the applicable withdrawal period. Italian legislation introduced a specific requirement for such a function for distance contracts concluded through an online interface.
8.3 Effects of withdrawal
Where the withdrawal is validly exercised, The New Own will process the refund in accordance with applicable law.
The Customer may be responsible for direct return costs or for any reduction in the value of goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where permitted by law.
8.4 Services beginning during the withdrawal period
Where a Customer expressly requests that a service begin before the expiry of the statutory withdrawal period, the legal consequences provided by applicable law will apply, including any applicable rules concerning payment for services already performed.
8.5 Statutory exceptions
The right of withdrawal does not apply where an exception established by applicable law applies.
The New Own will provide the Customer with any information concerning such exceptions that is relevant to the specific transaction.
9. RETURNS
9.1 Return procedure
At the end of the Rental Period, the Customer must return the Product through the procedure communicated by The New Own.
The return may take place through a designated Collection Point or another authorised return method.
9.2 Return confirmation
Where available, The New Own may provide the Customer with a return confirmation.
Customers should retain evidence of return until the relevant transaction has been completed.
9.3 Return logistics
The New Own may manage Product returns directly or through third-party logistics providers.
Where the Product must be returned to the Brand, The New Own will arrange the relevant transfer.
10. GARMENT CARE
10.1 Care obligations
Customers must follow the Product's care instructions.
Unless specifically authorised, Customers should not independently wash, dry-clean, repair or otherwise process Products where doing so could damage them.
10.2 Optional Care Service
Where available, the Customer may purchase an optional Care Service.
The price of the Care Service will be shown before payment. Where applicable to the current service, the standard Care Service price is €10.
Where the Care Service is purchased, The New Own will arrange the corresponding garment-care process.
11. DEPOSIT
11.1 Deposit
The New Own may require a refundable Deposit for certain Rentals.
Where applicable, the amount of the Deposit will be clearly displayed to the Customer before the Order is completed.
The Deposit is intended as security against loss, non-return or damage exceeding ordinary wear and tear.
11.2 Inspection
Following the return of the Product, the Product will be inspected in accordance with the operational procedure established by The New Own.
The relevant Brand may perform the physical inspection on behalf of The New Own.
11.3 Positive inspection
Where the Product is confirmed to have been returned in an acceptable condition, The New Own will release the Deposit.
The current operational procedure provides for the Deposit to be released within 72 hours after confirmation of a positive inspection.
11.4 Failure to complete inspection
The applicable inspection should normally be completed within the operational timeframe established by The New Own.
If the inspection is not completed within that timeframe and no valid extension has been requested, The New Own may automatically release the Deposit.
The operating agreement provides for a specific extension mechanism in objectively justified circumstances, including logistics delays, temporary inability to access the Product, documented technical problems and force majeure.
11.5 Damage
The Customer may be liable for:
- loss of the Product;
- intentional damage;
- damage caused by misuse or negligence;
- damage materially exceeding ordinary wear and tear.
The Customer will not be charged for ordinary wear resulting from proper use.
Where a damage charge is applied, The New Own may retain all or part of the Deposit and, where legally permissible, seek additional compensation for the actual loss exceeding the amount retained.
Any charge will be assessed in accordance with applicable law and the applicable Damage & Loss Policy communicated through the Platform.
12. PURCHASE OF A RENTED PRODUCT
12.1 Purchase option
Where the purchase option is available, the Customer may purchase the rented Product before the expiry of the relevant Rental Period or within the period specified on the Platform.
12.2 Purchase price
The Product's standard selling price is displayed on its Product page.
Where applicable, the Purchase price following Rental may be reduced depending on the number of Rentals previously recorded for that Product.
The applicable price will be displayed to the Customer before the Purchase is completed.
12.3 Rental-based reductions
The commercial model used by The New Own may provide reductions based on the number of previous Rentals of the same Product.
The applicable reduction will be calculated according to the conditions displayed on the Platform at the time of Purchase.
The underlying Brand agreement provides for graduated reductions depending on previous Rental activity.
12.4 Deduction of Rental payments
Where expressly indicated at checkout, Rental payments previously made by the same Customer for the same Product may be deducted from the applicable Purchase price.
Only Rental payments connected to the Customer's own Order are eligible.
12.5 Transfer of ownership
Ownership of a Product purchased through the Platform transfers to the Customer upon successful completion of the Purchase and receipt of payment, subject to applicable law.
13. PRICES AND PAYMENTS
13.1 Prices
The applicable price of each Product or service will be displayed before the Customer completes the Order.
Unless otherwise stated, prices include applicable VAT and mandatory taxes.
Any mandatory additional charge will be displayed before payment.
13.2 Payment methods
The New Own may make available different payment methods through third-party payment service providers.
The Customer must provide valid payment details and ensure that sufficient funds are available.
13.3 Payment processing
Payments may be processed by specialised third-party payment service providers.
The New Own does not ordinarily store complete payment card details where such information is processed directly by the relevant provider.
Information concerning payment-related personal data is provided in the Privacy Policy.
13.4 Failed payments
If payment cannot be successfully completed, The New Own may suspend or cancel the relevant Order.
14. COLLECTION POINTS
14.1 Availability
Products may be collected and returned through Collection Points selected and approved by The New Own.
Collection Points may include:
- participating Brand stores;
- partner businesses;
- coworking spaces;
- hotels;
- laundries;
- other authorised locations.
Available Collection Points will be displayed to the Customer during the ordering process.
14.2 Collection requirements
The Customer may be required to present an Order confirmation, identification document or other reasonable proof of entitlement before collecting a Product.
14.3 Changes to Collection Points
The New Own may change or temporarily suspend a Collection Point for operational reasons.
If this materially affects an existing Order, The New Own will provide the Customer with reasonable notice and, where appropriate, an alternative Collection Point.
15. RESPONSIBILITIES OF THE CUSTOMER
The Customer agrees to:
- provide accurate information;
- use the Platform lawfully;
- treat Products with reasonable care;
- return rented Products on time;
- comply with Product-specific care instructions;
- pay all amounts properly due;
- comply with Collection Point rules;
- refrain from circumventing the Platform or attempting to avoid applicable charges.
The Customer must not use the Platform to:
- impersonate another person;
- create fraudulent Accounts;
- interfere with the Platform's technical operation;
- introduce malicious software;
- use bots or automated systems to manipulate the Platform;
- access data belonging to other Users without authorisation;
- reproduce or commercially exploit the Platform's content without authorisation;
- use Products for unlawful purposes.
16. THE NEW OWN'S RESPONSIBILITIES
The New Own will provide the services described in these Terms with reasonable care and diligence.
The New Own will manage the consumer-facing relationship and coordinate, where necessary, with Brands, Collection Points, logistics providers, payment providers and other operational partners.
The Brand remains responsible towards The New Own for the obligations established under the relevant commercial agreement, including Product availability, Product information, authenticity, condition and timely preparation.
The allocation of responsibilities between The New Own and its suppliers does not limit the Customer's contractual rights against The New Own.
17. PRODUCT CONFORMITY AND LEGAL GUARANTEES
The New Own, as the Customer's contractual counterparty for purchases made through the Platform, is responsible for the consumer rights applicable to the Purchase under mandatory law.
Purchased Products must comply with the applicable legal conformity requirements.
Where a purchased Product is defective or does not conform to the contract, the Customer may benefit from the statutory remedies provided by applicable law.
The applicable statutory legal guarantee of conformity for consumer sales must not be excluded or reduced by these Terms. Under the EU framework, the seller is liable for lack of conformity that exists at delivery and becomes apparent within the applicable statutory period, with a minimum two-year framework under EU law.
For rented Products, the Customer's rights concerning defects, safety and conformity remain protected by mandatory applicable law.
18. COMPLAINTS AND CUSTOMER SUPPORT
The Customer may submit complaints, requests for assistance or claims directly to The New Own.

Where relevant, the Customer should include:
- Order number;
- Product concerned;
- date of Order;
- description of the issue;
- photographs or other supporting material where appropriate.
The New Own will examine complaints and take the appropriate action in accordance with the applicable contractual and legal framework.
19. INTELLECTUAL PROPERTY
19.1 The New Own content
The Platform and all content made available by The New Own, including:
- trademarks;
- logos;
- graphics;
- photographs;
- text;
- software;
- layouts;
- interfaces;
- databases;
are protected by applicable intellectual property laws and belong to The New Own or its licensors.
The Customer receives only a limited, non-exclusive and non-transferable right to use the Platform for its intended personal purposes.
19.2 User content
Where the Platform allows Customers to submit reviews, comments, photographs or other content, the Customer must ensure that such content:
- is truthful;
- does not violate another person's rights;
- does not contain unlawful or defamatory material;
- does not contain malicious code;
- does not unlawfully disclose personal data.
The New Own may remove content that violates these Terms or applicable law.
20. REVIEWS AND FEEDBACK
Where reviews are available, Customers may review Products and services based on their genuine experience.
Reviews must not be misleading, fraudulent, abusive or submitted in exchange for an undisclosed benefit.
The New Own may moderate or remove reviews where required by law or these Terms.
The New Own does not guarantee that all reviews displayed on the Platform are representative of all Customer experiences.
21. ARTIFICIAL INTELLIGENCE AND PERSONALISATION
The Platform may use artificial intelligence or automated technologies for features such as:
- personalised recommendations;
- product discovery;
- shopping assistance;
- sizing or fit recommendations;
- virtual fitting;
- other personalisation services.
Such functionality is intended to assist the Customer and does not constitute a guarantee that a Product will fit, suit the Customer or produce a particular result.
Where a feature requires the processing of personal data subject to specific legal protections, the relevant processing will be governed by the Privacy Policy and any additional consent mechanism applicable to that feature.
Where a particular AI feature is not available in the version of the Platform used by the Customer, the corresponding provisions do not create an obligation on The New Own to provide that feature.
22. PERSONAL DATA AND COOKIES
The processing of personal data in connection with the Platform is governed by the Privacy Policy.
The use of cookies and similar technologies is governed by the Cookie Policy and the Platform's cookie-consent mechanism.
Both documents are available on the Platform.
23. PLATFORM AVAILABILITY AND TECHNICAL ISSUES
The New Own will use reasonable efforts to keep the Platform available.
However, uninterrupted or error-free operation cannot be guaranteed.
The Platform may temporarily be unavailable because of:
- maintenance;
- technical failures;
- internet or telecommunications failures;
- cybersecurity incidents;
- third-party service failures;
- force majeure;
- circumstances beyond The New Own's reasonable control.
The New Own may modify, update, suspend or discontinue individual Platform features where reasonably necessary, while respecting existing contractual rights and mandatory consumer law.
24. THIRD-PARTY SERVICES
The New Own may rely on third parties to provide certain operational or technical services, including:
- payment processing;
- logistics;
- Collection Point services;
- garment care;
- hosting and infrastructure;
- authentication;
- analytics;
- communication services.
The use of such providers does not alter The New Own's status as the Customer's contractual counterparty for the relevant Platform transaction.
25. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.
The New Own is responsible for performing the contractual obligations it has undertaken towards the Customer and for the mandatory consumer rights applicable to the relevant transaction.
The New Own will not be responsible for delays or failures caused exclusively by circumstances beyond its reasonable control, including force majeure events, subject always to mandatory consumer rights.
Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
26. FORCE MAJEURE
The New Own will not be considered in breach of these Terms where performance is prevented or materially delayed by circumstances beyond its reasonable control.
Such circumstances may include, by way of example:
- natural disasters;
- war or civil unrest;
- strikes;
- transport disruption;
- widespread technical failures;
- cyberattacks;
- governmental restrictions;
- other extraordinary events beyond reasonable control.
The New Own will use reasonable efforts to reduce the impact of such circumstances and resume performance as soon as reasonably possible.
27. CHANGES TO THESE TERMS
The New Own may update these Terms where reasonably necessary, including because of:
- changes to the Platform;
- new services;
- changes in technology;
- changes in applicable legislation;
- security requirements;
- operational developments.
The updated Terms will be published on the Platform and will indicate the applicable effective date.
Changes will not retroactively alter contractual rights already accrued by a Customer, except where required or permitted by law.
Where legally required, Customers will receive appropriate notice of material changes.
28. GOVERNING LAW AND CONSUMER PROTECTION
These Terms are governed by Italian law, without prejudice to any mandatory consumer protection rules applicable to the Customer under EU law or the law of the Customer's country of habitual residence where those rules cannot be contractually excluded.
Nothing in these Terms deprives the Customer of mandatory rights provided by applicable consumer protection legislation.
29. DISPUTE RESOLUTION
The New Own encourages Customers to contact customer support before initiating formal proceedings so that complaints can be resolved amicably.
Where available and applicable, Customers may make use of recognised alternative dispute resolution mechanisms under applicable consumer legislation.
Nothing in this section prevents a Customer from bringing proceedings before any court having jurisdiction under mandatory applicable law.
Where the Customer qualifies as a consumer, any contractual jurisdiction provision shall apply only to the extent permitted by mandatory law.
30. SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be interpreted or replaced to the extent legally possible so as to preserve its intended purpose.
The remaining provisions will continue in full force and effect.

ANNEX II
CUSTOMER CANCELLATION AND RETURN SUMMARY
For convenience, the main operational rules are summarised below. In all cases, mandatory statutory consumer rights prevail.
Order cancellation:
The Customer may ordinarily cancel an Order within 48 hours of payment for a refund.
After confirmation:
Subject to statutory rights, cancellation may result in a Coupon rather than a refund, where requested within the applicable timeframe shown on the Platform.
Rental periods:
2 weeks, 1 month or 3 months, depending on Product availability.
Order preparation:
The Product is normally made available by the relevant Brand within 48 hours.
Delivery to Collection Point:
The New Own's operational target is delivery within 72 hours from Order placement.
Return:
The Product must be returned through the authorised return process at the end of the Rental Period.
Deposit:
Where applicable, the Deposit is released following a successful inspection, subject to the applicable operational and legal procedure.
Purchase after Rental:
Where available, the Customer may purchase the rented Product at the price displayed on the Platform, potentially benefiting from a Rental-based reduction.
